By exploring the meaning construction of Chinese citizenship stipulated in Chinese legislation and its interaction with social identities and human nature in the Chinese society, the present study investigates the nature and evolution of the conception of Chinese citizens through three selected cases from Chinese legislations, which illuminate that Chinese citizens are essentially persons with independent personalities defined by the rights and obligations stipulated in legislation. This conception is further strengthened by the entitlement to private properties and equality before law. (...) This conception of Chinese citizenship is concrete and meaningful in the sense that it is underpinned with reference to social identities as person, people and personality in Chinese legislations. The reference of the conception to human being constitutes the essence of Chinese legislation. The meaning construction of Chinese citizenship is indeed a dynamic process engineered in the social and cultural process. The findings on the evolution of the construction of Chinese citizenship in Chinese legislation suggest that the formation of legal identity through legislation varies greatly in different countries. Nevertheless, the realization of the conception of citizenship will necessarily be backed up by social identities as person, people and personality, which will be further strengthened and expanded by the legitimating of private properties and equality before law. ‘A whole man, made of all men, worth all of them, and any one of them worth him.’ This was how Jean-Paul Sartre characterized himself at the end of his autobiographical study, Words. And Bernard-Henri Lévy shows how Sartre cannot be understood without taking into account his relations with the intellectual forebears and contemporaries, the lovers and friends, with whom he conducted a lifelong debate. His thinking was essentially a tumultuous dialogue with his whole age and himself. He learned from (...) Gide the art of freedom, and how to experiment with inherited fictional forms. He was a fellow-traveller of communism, and yet his relations with the Party were deeply ambiguous. He was fascinated by Freud but trenchantly critical of psychoanalysis. Beneath Sartre’s complex and ever-mutating political commitments, Lévy detects a polarity between anarchic individualism on the one hand, and a longing for absolute community that brought him close to totalitarianism on the other. Lévy depicts Sartre as a man who could succumb to the twentieth century’s catastrophic attraction to violence and the false messianism of its total political solutions, while also being one of the fiercest critics of its illusions and shortcomings. This book brings together new essays on a major focus of debate in contemporary metaphysics: does time really pass, or is our ordinary experience of time as consisting of past, present, and future an illusion? The international contributors broaden this debate by demonstrating the importance of questions about the nature of time for philosophical issues in ethics, aesthetics, psychology, science, religion, and language.

Spacetime functionalism is the view that spacetime is a functional structure implemented by a more fundamental ontology. Lam and Wüthrich have recently argued that spacetime functionalism helps to solve the epistemological problem of empirical coherence in quantum gravity and suggested that it also (dis)solves the hard problem of spacetime, namely the problem of offering a picture consistent with the emergence of spacetime from a non-spatio-temporal structure. First, I will deny that spacetime functionalism solves the hard problem by showing that it (...) comes in various species, each entailing a different attitude towards, or answer to, the hard problem. Second, I will argue that the existence of an explanatory gap, which grounds the hard problem, has not been correctly taken into account in the literature. (shrink)

This article addresses the problem of automatically extracting legal indices which express the important contents of legal documents. Legal indices are not limited to single-word keywords and compound-word keywords, they are also clause keywords. We approach index extraction using structural information of Japanese sentences, i.e. chunks and clauses. Based on the assumption that legal indices are composed of important tokens from the documents, extracting legal indices is treated as a problem of collecting chunks and clauses that contain as many important (...) tokens as possible. Each token is assigned a weight which is a statistical score, e.g. TF–IDF and Okapi BM25, to indicate its importance. The importance of a chunk or clause is determined based on the average weight of tokens included in that chunk or clause. Then, highly weighted chunks and clauses are recognized as the indices for legal documents. The experimental results on Japanese National Pension Act data show that our proposed method achieves better performance than TextRank, the most popular unsupervised method in extracting single-word and compound-word keywords. In addition, this approach is also applicable to extract clause keywords with high performance. (shrink)

Eternalism, the view that what we regard locally as being located in the past, the present and the future equally exists, is the best ontological account of temporal existence in line with special and general relativity. However, special and general relativity are not fundamental theories and several research programs aim at finding a more fundamental theory of quantum gravity weaving together all we know from relativistic physics and quantum physics. Interestingly, some of these approaches assert that time is not fundamental. (...) If time is not fundamental, what does it entail for eternalism and the standard debate over existence in time? First, I will argue that the non-fundamentality of time to be found in string theory entails standard eternalism. Second, I will argue that the non-fundamentality of time to be found in loop quantum gravity entails atemporal eternalism, namely a novel position in the spirit of standard eternalism. (shrink)

This text examines the reception of Nietzschean thought by Marcel Proust. To this end, the reception scenario of Nietzschean thought in France is demonstrated, and how Proust was situated within it. We confirm that Proust had a profound philosophical background. However, it is shown here that, although supposedly the only work by Nietzsche carefully read by Proust was The Case of Wagner, the German philosopher had a significant influence on his novels. It is concluded that, despite Proust's divergences from Nietzsche, (...) both authors agree that literature gives meaning to existence, helps in living, and allows access to true life. (shrink)

In a recent article, Ned Markosian gives an argument against four-dimensionalism understood as the view that time is one of four identical dimensions that constitute a single four-dimensional manifold. In this paper, I show that Markosian attacks a straw man as his argument targets a theory known to be false on empirical grounds. Four-dimensionalism rightly conceived in no way entails that time is identical to space. I then address two objections raised by Markosian against four-dimensionalism rightly conceived.

Archives are being digitised on an enormous scale worldwide, and the connections between Aby Warburg’s Mnemosyne Atlas and the contemporary digital accumulation of data have not been lost on contemporary scholars. By problematising what I suggest is a simplified relation between repetition and replication in the transmission of Warburg’s body of work into a digital era, I believe that an engagement with contemporary digital discourse provides the possibility of seeing his work in a new light while allowing for insights into (...) how Warburg might be instrumental in rendering visible possible discrepancies between individual entities and larger collective patterns, whether within his Mnemosyne Atlas or among datasets more broadly speaking. Elgin has argued that scientific models that are, strictly speaking, inaccurate representations of the world, are epistemically valuable because the “falsehoods” they contain are “felicitous”. Many, including Elgin herself, have interpreted this claim as offering an alternative to scientific realism and “veritism”. In this paper, I will argue that there is a more felicitous interpretation of Elgin’s work: “felicitous falsehoods” do play a role in the epistemic value of inaccurate models, but that role is of instrumental value. Elgin’s view is (...) not best understood as claiming that falsehoods provide scientific understanding in and of themselves, only that they facilitate epistemic access to the fundamental, even if partial, truths that are contained within models. While falsehoods may be felicitous in that they facilitate exemplification, the epistemic value of inaccurate models ultimately relies on their partial accuracy. (shrink)

Rik Peels has forcefully argued that, contrary to what is widely held, ignorance is not equivalent to the lack or absence of knowledge. In doing so, he has argued against the Standard View of Ignorance according to which they are equivalent, and argued for what he calls “the New View” according to which ignorance is equivalent (merely) to the lack or absence of true belief. In this paper, I defend the Standard View against Peels’s latest case for the New View.

As Hong Kong is the only common law jurisdiction operating in Chinese, alongside English, writing a common law judgment in Chinese is like exploring an uncharted domain in legal discourse. Apart from those judgments originally written in Chinese, Chinese judgments have also been prepared by way of translation from English. Besides, there are also English translations of Chinese judgments of jurisprudential value. Judgments in Hong Kong therefore present an interesting case for study both from a legal point of view and (...) from the perspective of discourse analysis. As Chinese judgments in Hong Kong to a large extent mirror images of their English counterparts, they provide us with insights into how judicial thinking embodied in one language is carried over to another. As the translation of court judgments can serve as a clue to the understanding of how judicial thinking is transferred and reflected in another language, this study looks into some of the fundamental problems of legal translation in general and translation of court judgments in particular, showing how the sociosemiotic approach can shed light on those problems. Can we rely on the altruism of professionals or the public service ethos to deliver good quality health and education services? How should patients, parents and pupils behave - as grateful recipients or active consumers? The book provides new answers to these questions, and evaluates recent government policies in health services, education, social security and taxation, and puts forward proposals for policy reform: universal capital or 'demogrants', discriminating vouchers, matching grants for pensions and for long-term care and hypothecated taxes.

The nomenclature of the Anthropocene for this geological epoch marks in a novel way the global impact of human activity on the world. Consequently, it creatively raises the alarm bell of global environmental devastation. However, the narrative implicit in the Anthropocene presents challenges to use it as a departure point for developing an ethics of responsibility, as it contains morally relevant but ambiguous etiologies, phenomenological challenges to discrete human agency, and the potential erasure of both causes and victims of global (...) environmental degradation. This challenge compounds the challenges to traditional models of responsibility-as-imputation by global forms of environmental degradation signaled in the Anthropocene. Our new epoch demands new models of responsibility. This article draws upon neglected work by Paul Ricoeur to reconstruct a twofold model of responsibility: (1) responsibility-as-imputation and (2) responsibility for the fragile other and the domains that amplify fragility. It shows that a twofold model can more completely respond to harms elicited by anthropogenic environmental degradation by maintaining the benefits of traditional models of responsibility-as-accountability while dramatically expanding the subject and objects of responsibility through attention to the fragile and thus better serving us as we navigate responsibility in the Anthropocene. O confucionismo existe, na vida espiritual do povo vietnamita, desde muito tempo. A parte positiva do Confucionismo pode-se dizer que é o fato de ele contribuir para o fortalecimento das relações familiares, entre os parentes, bem como nas relações sociais de um modo geral; outra parte positiva consiste em motivar as pessoas a desenvolverem o gosto pela leitura e aprendizagem. Estima-se que a ética confucionista precisa ser provocada, a fim de contribuir para a construção da sociedade nos dias atuais. Na (...) contramão dessa positividade, pode-se afirmar que o confucionismo, de maneira geral, não valoriza, na medida necessária, o papel das mulheres na sociedade; na realidade, ele as classifica como pessoas insignificantes. É digno de se observar, entretanto, que, no contexto social específico do Vietnã, as mulheres encontram um lugar próprio na sociedade. Nossa pesquisa visa mostrar exatamente essa diferente concepção do papel da mulher na socidade vietnamita. (shrink)

Le " libre arbitre ", cette capacité à choisir librement ou encore à déterminer notre propre volonté, semble menacé par les avancées de la psychologie et des neurosciences contemporaines. Or, certaines interrogations philosophiques doivent être résolues avant de tirer les conséquences de ces résultats empiriques : le déterminisme causal, qui est au fondement de toute démarche scientifique, est-il compatible avec la notion de libre arbitre? Quel type de relation entretiennent l'esprit et le cerveau? L'examen de ces problèmes fondamentaux constitue le (...) préalable à l'interprétation des données issues des neurosciences, en particulier des expériences de Benjamin Libet qui ont semblé remettre en question l'efficacité causale de nos décisions conscientes. Par ailleurs, il est légitime de se demander si les limites de la conscience et le rapport qu'elle entretient avec les processus inconscients, qu'ils relèvent de l'Inconscient freudien ou de l' " inconscient cognitif " mis en lumière par les neurosciences, constituent un frein à l'exercice de notre liberté. Cet ouvrage esquisse une solution nouvelle à ces questions. Il montre comment la psychologie et les neurosciences, bien que menaçant la conception traditionnelle du libre arbitre, permettraient de concevoir en leur sein même une redéfinition de cette notion, envisagée comme une capacité relative et non plus absolue, nécessitant un apprentissage.
